LEGAL FRAMEWORK
The following terms and conditions apply to all bookings of rooms and suites sold and managed by ARES Company – Le Daya Hotel & Spa *****.
The information provided in this document reflects the regulations in force at the time of publication and may be subject to change thereafter. This rental agreement is concluded for temporary residence and leisure purposes only. Under no circumstances may the guest carry out any commercial, artisanal, or professional activity on the premises. These terms of sale, as well as any matters referenced therein, are governed by French law.
REGISTRATION & BOOKING
Information required before any booking:

Number of guests: Upon booking, you will be asked to specify the number of people—adults and children—who will be occupying the room or suite during the stay. Under no circumstances may this number exceed the room or suite’s maximum capacity.

Pets: Pets are not allowed in the hotel.

Guests with special needs: Any person requiring special assistance due to health conditions must be mentioned at the time of booking so that we may assess whether the stay is suitable and, if needed, provide appropriate accommodation or advice.
The published rates are public, in euros, including taxes and service charges, except for the tourist tax. Rates are subject to change without notice.
A booking is only confirmed upon receipt of a deposit or down payment, as follows:

For non-refundable offers, the full amount of the stay must be paid at the time of booking.

For all other offers, a 50% deposit of the total stay is required. The balance must be paid upon arrival.
In all cases, upon arrival, a credit card will be required for a €500 pre-authorization to cover any additional charges.
CHANGES – CANCELLATION
Change of stay: In the event of force majeure, beyond our control, or for evident safety or maintenance reasons, we may be required to partially or completely alter a guest’s stay.
Changes to essential elements of the stay:
By the hotel: Once informed, the guest may cancel the contract and receive a full refund of any amounts paid, or accept the proposed modification, in which case an amendment will be signed between both parties.
By the guest: Once we receive notice by registered letter, we will do our best to accommodate the change. If not possible, the change will be treated as a cancellation and subject to the applicable cancellation terms.
Cancellation:
We recommend that guests take out cancellation insurance with their insurance provider.
Guests who cannot arrive on the scheduled day will be charged 100% of the applicable nights.
Guests who wish to leave before the end of their stay will also be charged 100% of the remaining nights.
Bookings are only confirmed once the deposit mentioned under “Registration & Booking” has been received.
For refundable cancellations, a €30 processing fee per file will apply. Cancellation requests will be processed within 30 days.
All bookings (except non-refundable offers) are subject to the following cancellation terms:
Cancellation free of charge up to 7 days before arrival: the deposit will be refunded.
Cancellation within 7 days of arrival: 100% penalty, the total amount will be charged automatically.
SPECIAL COVID-19 POLICY
• If the French government closes the borders, cancellation is possible with either a postponement or refund.
• If the French government bans travel from a specific country or region, cancellation is possible with postponement or refund.
• If a foreign government bans its citizens from traveling, advises against travel, or imposes a quarantine, cancellation is possible with postponement or refund.
• If travelers (French or foreign) test positive for COVID-19 less than 72 hours before arrival, cancellation is possible with postponement or refund.
Conditions of application:
Submission of the positive test result in the name of the traveler, in French or English
If the reservation includes multiple rooms, only the room of the guest(s) testing positive will be canceled
At the time of booking, it is mandatory to provide names and ID of all occupants of the room or suite. If this information is not provided at the time of booking confirmation, no cancellation will be possible in the event of a positive test.
STAY INTERRUPTION
If the stay is interrupted for any reason beyond the hotel’s control, no refund will be granted. We strongly recommend purchasing travel insurance to cover this eventuality.
LIABILITY
Hotel’s liability: Safes are available in all rooms and suites. The hotel is not liable for any loss or theft.
Guest’s liability: In the event of missing items or damage in the room or suite, the cost of repairs will be charged at the end of the stay. In the event of inappropriate behavior or intentional damage, the management reserves the right to immediately terminate the stay without any refund or compensation. Restoration costs will be billed to the guest.
THE STAY
Arrival and departure times must be respected; otherwise, the guest will be charged an additional night’s rate.
Check-in: from 4:00 PM (guaranteed availability)
Check-out: by 11:00 AM
All payments are due on the date specified in the booking agreement and in accordance with the terms of sale.
In case of bank transfers or card payments, bank fees are at the customer’s expense.
Cheques and foreign currency are not accepted.
Extras for hotel guests (rooms and suites) must be paid on departure, either by card or in cash at reception.
SECURITY
House rules: Each guest is responsible for any disturbances or damages caused. If the peace, integrity, or safety of those living or working on the premises is affected, we reserve the right to immediately terminate the stay without compensation. Guests must avoid careless or negligent acts—such as leaving the room or suite unlocked or unattended. Rooms and furnishings must be used under normal conditions.
Under no circumstances will our company be held liable in the following cases:
Stolen or damaged items:
Our company cannot be held responsible for theft or damage to guests’ personal belongings in rooms or suites. A safe is provided in every accommodation. Guests are solely responsible for their possessions during their stay.
External Services:
For safety reasons, it is strictly forbidden to hire outside providers for food delivery, beverages, catering, massages, babysitting, housekeeping, etc., in rooms or suites. Our hotel can arrange all desired services through our concierge.
POOL ACCESS
Direct, active, and visual supervision by an adult is essential and under the guest’s full responsibility. Failure to comply with pool regulations will result in immediate and permanent exclusion. To ensure children’s safety, the following precautions must be observed:
Never leave a child alone in the water, even if they can swim
A child must always be supervised by an adult capable of rescuing them in case of emergency
Never leave toys or objects floating that might entice a child near the water
Young children must always wear floatation armbands
ARES Company – Le Daya Hotel & Spa ***** shall not be held responsible in case of accident or death.
LIABILITY & CLAIMS
Liability: To ensure your safety and peace of mind, our hotel is monitored 24/7. However, each guest is responsible for themselves, and it is their duty to use the safes and services provided. Under no circumstances will the hotel be held liable for damage or theft in rooms or suites. Guests must be able to present civil liability and multi-risk insurance.
